FILE FCP-53 HISTORICAL CASE FILE

Theranos blood-testing claims and investor fraud

ASSESSMENT: Investor fraud was established on specified counts; jury outcomes do not prove every Theranos claim or criminal patient harm.

Documented findings, economic interpretation and unresolved claims are assessed separately.

Claim under review

Did Holmes and Balwani knowingly mislead investors about device capabilities, validation and commercial use?

Chronology

CMS inspections found laboratory deficiencies in 2015–16. Holmes was convicted in 2022 on four investor-fraud counts and acquitted on others; Balwani was convicted on all submitted counts. Theranos dissolved in 2018.

Court, regulatory and primary evidence

Trial presentations, technical testimony and jury verdicts establish count-specific investor fraud. CMS separately documented lab deficiencies, not every investor representation.

Independent cross-checks

Independent corroboration: DOJ, Balwani conviction (2022) provides a separate record relevant to this case. Named defendant and count-specific jury verdict.

Competing account and limits

Holmes was acquitted on patient-related counts; neither verdict proves every public claim criminal. Defendants said they believed the technology could work.

Evidence that could alter this assessment

Contemporaneous validation data, executive communications on failures and appellate rulings could refine knowledge or scope.

Skeptical finding

Investor fraud was established on specified counts; jury outcomes do not prove every Theranos claim or criminal patient harm.
