FILE FCP-57 HISTORICAL CASE FILE
Airbus intermediaries and global bribery resolution
ASSESSMENT: Serious intermediary and disclosure failures established within resolution scope; Airbus was not U.S.-jury convicted and not every payment was corrupt.
Documented findings, economic interpretation and unresolved claims are assessed separately.
Claim under review
Did Airbus use intermediaries for corrupt payments and fail to disclose information required by authorities?
Chronology
SFO investigations began in 2016. Coordinated UK, French and U.S. resolutions followed in January 2020, totalling roughly €3.6bn. UK and U.S. used deferred prosecutions; France used a judicial public-interest agreement.
Court, regulatory and primary evidence
SFO court-approved DPA, DOJ DPA and French CJIP define agreed facts and different national offenses. This was not one jury verdict.
Independent cross-checks
Independent corroboration: DOJ Airbus global resolution (2020) provides a separate record relevant to this case. U.S. DPA and export-control/disclosure facts.
Competing account and limits
Airbus did not plead guilty in U.S.; DPA is conditional. French agreement is negotiated, not trial conviction. Not all intermediary payments were proved bribes.
Evidence that could alter this assessment
Compliance findings, individual cases and transaction-level records could alter specific operation or person findings.
Skeptical finding
Serious intermediary and disclosure failures established within resolution scope; Airbus was not U.S.-jury convicted and not every payment was corrupt.
