FILE FCP-55 HISTORICAL CASE FILE
1MDB, bond proceeds and Goldman Sachs
ASSESSMENT: Diversion and bribery tied to specified offerings are established; findings do not implicate all Goldman staff or Malaysian officials.
Documented findings, economic interpretation and unresolved claims are assessed separately.
Claim under review
Were 1MDB bond proceeds diverted, and did Goldman personnel facilitate offerings while ignoring bribery red flags?
Chronology
Goldman arranged three 2012–13 offerings worth $6.5bn. DOJ alleged more than $2.7bn was misappropriated. Goldman Malaysia pleaded guilty in 2020; parent entered a deferred prosecution agreement. Banker Roger Ng was convicted in 2022.
Court, regulatory and primary evidence
DOJ plea facts, Ng verdict and forfeiture cases document specific offerings, bribes and asset tracing; parent DPA is not jury conviction. Not all proceeds were alleged stolen.
Independent cross-checks
Independent corroboration: DOJ, Roger Ng conviction (2022) provides a separate record relevant to this case. Jury verdict against named banker.
Competing account and limits
Negotiated parent resolution differs from subsidiary plea; actors and transaction amounts vary. Scandal does not prove every political connection.
Evidence that could alter this assessment
Final forfeiture accounting, bank records and remaining defendants’ cases could alter amounts and individual knowledge.
Skeptical finding
Diversion and bribery tied to specified offerings are established; findings do not implicate all Goldman staff or Malaysian officials.
